Welcome to GoVacay. These Terms of Service ("Terms") govern your access to and use of the GoVacay website, newsletter, and certificate program (collectively, the "Service") operated by GoVacay.online ("we," "us"). By subscribing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. The Newsletter

GoVacay delivers a travel newsletter containing certificates, deals, and travel content. We make no guarantee about send frequency, and we may modify or discontinue any part of the Service at any time.

3. The Certificate Program

This section governs how certificates are earned and redeemed.

• Earning: Certificates may be credited for actions such as subscribing ($25), reading editions ($25 each), and referring friends ($50 each), subject to the rules we publish.
• Nature of certificates: Certificates are promotional credits redeemable only toward eligible travel bookings through GoVacay's partners. Certificates are not cash, have no cash value, and are non-transferable.
• Redemption: Certificates are redeemable toward eligible travel through our partners. Redemption terms vary by supplier and are subject to partner availability, blackout dates, and the specific conditions of each offer.
• Expiration: Certificate expiration varies by supplier and offer. Applicable expiration terms will be disclosed with each certificate or offer.
• Limits & abuse: We may cap, withhold, or void certificates obtained through fraud, fake referrals, automated means, or violation of these Terms.
• Changes: We may modify certificate values, earning rules, and redemption terms at any time. Material changes will be communicated by email.
• Taxes: Any tax liability arising from certificates or rewards is solely your responsibility.

4. Referrals

Referral rewards require that referred individuals are genuine, new subscribers who opt in themselves. Self-referrals, fake accounts, purchased lists, spam, and automated sign-ups are prohibited and may result in forfeiture of certificates and termination of your access.

5. Paid Wholesale Membership (GoVIP)

GoVacay offers an optional paid membership ("GoVIP") for $99 per year. GoVIP unlocks access to members-only wholesale travel pricing and related benefits as described on our site. Membership renews automatically each year at the then-current annual rate unless you cancel before your renewal date. All GoVIP membership fees are non-refundable, including after automatic renewal. You may cancel at any time to prevent future renewals; cancellation stops the next renewal but does not refund fees already paid.

6. Acceptable Use

You agree not to misuse the Service, including by attempting to game the certificate program, scraping, reselling certificates, or interfering with the Service.

7. Intellectual Property

The Service and its content are owned by GoVacay.online and protected by applicable laws. You may not reproduce it without permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

GoVacay is a newsletter and certificate-distribution service. Travel, accommodations, and related services are provided by independent third-party partners and suppliers, not by GoVacay. We do not control and are not responsible for the acts, omissions, availability, quality, or fulfillment of any partner or supplier. Any dispute regarding a booking, stay, or travel service is between you and the applicable supplier.

9. Limitation of Liability

To the fullest extent permitted by law, GoVacay.online and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service, the certificate program, or any travel or services provided by partners or suppliers. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access, and void unredeemed certificates, if you violate these Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
